Fatal Single-Vehicle Accidents in California and Wrongful Death Claims

Even if the deceased was driving, it cannot always be assumed that he bears full responsibility in a fatal single-vehicle accident. If the negligence of outside parties — such as the vehicle manufacturer in cases of equipment malfunction or government entities responsible for maintaining roadway conditions — contributed to the crash, the family of the deceased may have grounds for a wrongful death claim. A wrongful death claim can provide compensation for funeral expenses and the loss of support and companionship provided by the deceased.

If it is found that negligence on the part of the deceased also played a role, any settlement may be reduced in proportion to his responsibility for the crash, but that does not prohibit the victim’s family from receiving partial compensation.
