Accidents in Oakland and Personal Injury and Wrongful Death Claims
As CHP investigators examine physical evidence at the crash site and take statements from witnesses, they will attempt to build a picture of what events led to this accident and which parties involved might be found liable. Because California operates under the principle of comparative negligence, the drivers of both vehicles might share in liability.
Depending on findings, those hospitalized following this crash may have grounds to pursue personal injury claims with the insurance provider of the at-fault party or parties. A personal injury claim can provide compensation for medical expenses, pain and suffering, lost wages, and other damages stemming from the accident.
The family of the Ford driver who lost their life may also have grounds to pursue a wrongful death claim. A wrongful death claim can compensate for such damages as funeral expenses and the loss of support and companionship provided by the deceased.
