Sonoma County Fatal Accidents and Wrongful Death Claims

After a collision that results in a fatality, like the car versus motorcycle accident described here, investigators examine evidence at the crash site to determine which party involved may have been at fault. Because California law operates under the legal principle of comparative negligence, liability for an accident can be shared among multiple parties.

If another party was found to be even partially negligent an accident leading to someone’s death, the victim’s family may have grounds for a wrongful death claim. A wrongful death claim can provide compensation for damages such as funeral expenses, and the loss of companionship and support the victim provided. However, if negligence on the part of the deceased also contributed to their death, any settlement may be reduced.
