San Jose Fatal Pedestrian Hit-and-Runs and Wrongful Death Claims
California law requires that drivers exercise an additional duty of care toward pedestrians, due to their greater vulnerability to serious injury in a collision. That includes taking all reasonable measures to avoid striking them and, if an accident does occur, remaining with the pedestrian, assisting them in finding medical care, and cooperating with authorities.
By fleeing the accident site, the vehicle or vehicles that fatally struck the pedestrian involved in this accident may be determined to have committed “negligence per se.” This means that, by having violated a traffic safety law, the drivers could be automatically considered to have been negligent, which can increase their share of liability for the pedestrian’s fatal injuries.
If the drivers responsible are found, the family of the deceased may have grounds to pursue a wrongful death claim with those drivers’ insurance provider. However, should those drivers escape justice, the family might be able to seek compensation through their uninsured motorist coverage. A wrongful death claim can help to recover damages related to this fatal accident, such as funeral costs and the loss of support and companionship from the deceased.
