Fatal Pedestrian Crash at SR-85, Camden Ave Off-Ramp in San Jose

San Jose, CA – In the early hours of Thursday, August 6, 2026, a pedestrian collision resulted in a fatality, according to CHP Fatal.

The California Highway Patrol reports that the accident took place around 1:37 AM on southbound State Route 85 near the Camden Avenue off-ramp.

Authorities said a pedestrian was found lying in the slow lane after an object struck a passing vehicle’s windshield, injuring the driver, who pulled over to the right shoulder. An off-duty Santa Clara County Sheriff’s deputy came upon the scene and requested lanes one and two be blocked due to fast-approaching traffic. No vehicles were found to be directly associated with the collision at the time. Other motorists were seen pulling over onto the shoulder along Camden Avenue.

A traffic break was initiated south of Camden Avenue, and all southbound traffic was diverted to the Camden Avenue off-ramp. The coroner was notified and responded to the scene. The Santa Clara County Sheriff’s Office assisted with closing the Camden Avenue off-ramp during the investigation. All lanes were reopened at approximately 3:49 AM.

No additional details regarding the identity of the deceased had been released at the time of reporting. The investigation remains ongoing.

San Jose Pedestrian Accidents and Wrongful Death Claims

California law requires drivers to exercise an extra duty of care toward pedestrians, remaining vigilant and prepared to stop even on freeways where pedestrian presence is unexpected, particularly during low-visibility nighttime conditions. When a pedestrian collision results in a fatality, investigators with California law enforcement examine visibility, speed, and the actions of any drivers in the area to determine the cause and whether any party may bear liability.

Regardless of the findings, the family of the deceased may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
