Kern County Bicycle Accidents and Wrongful Death Claims
California law requires drivers to exercise a heightened duty of care around bicyclists, particularly minors, remaining alert and prepared to stop when cyclists are present in or near the roadway. When a collision results in the death of a young cyclist, investigators examine the driver’s conduct, visibility conditions, and other factors to determine liability.
Regardless of the findings of the investigation, the family of the deceased may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
