Shasta County Car Accidents and Wrongful Death Claims

California law requires drivers to operate their vehicles with reasonable care at all times, including adjusting their speed and attention to nighttime driving conditions. When a single-vehicle collision results in a fatality, investigators will examine factors such as speed, road conditions, and driver impairment to determine the cause and whether any third party may bear liability.

Regardless of the initial findings of the investigation, the family of the deceased may have the right to pursue a wrongful death claim. A wrongful death claim can provide compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.

Passenger Liability

A driver’s liability coverage extends to those inside their vehicle as well as outside. In many cases, those passengers are someone who knows the driver personally. So, when a passenger is injured and their driver is found liable, they may feel reluctant to file a claim against the driver’s insurance.

In many cases, however, a personal injury claim may be required for an insurer to offer a fair settlement that covers the injured party’s medical expenses, pain and suffering, and other damages related to the accident. A personal injury attorney can facilitate this process and, as a neutral third party, help navigate any emotional complexities that may arise.
