The vehicles involved included a black Honda Civic, which ended on the right-hand shoulder of the highway, and a blue Toyota Highlander, which is believed to have been the vehicle that struck the pedestrian. The Toyota contacted authorities and cooperated with investigations.

Comparative Liability
Determining fault in a collision can involve multiple factors, and under California’s Comparative Liability rule, several parties can share partial responsibility. Should evidence reveal that another party contributed to the injuries, victims may be eligible to file a personal injury claim with the responsible party’s insurance.
Duty of Care Toward Pedestrians
Drivers have a Duty of Care towards pedestrians, who are particularly vulnerable in traffic accidents. This responsibility includes being vigilant for pedestrians near the roadway and, if a collision occurs, staying with the victim to ensure they get proper medical treatment and cooperating with authorities investigating the crash.
