Merced, CA – On the night of Friday, December 13, 2024, a man lost his life when he was struck by a vehicle while riding his bicycle in Merced, according to KSEE.
The Merced Police Department reports that the fatal accident occurred at 23rd Street and Glen Avenue around 9:15 PM.
Emergency responders found the wounded bicyclist lying on the road when they arrived. Unfortunately, he succumbed to his injuries and authorities pronounced him dead at the scene.
Initial investigations suggest that the bicyclist had apparently been traveling westbound on 23rd Street and failed to come to a stop at the Glen Avenue intersection. When the bicyclist entered the intersection, he was struck by a vehicle that had been traveling northbound on Glen Avenue.
Neither the identities of the bicyclist nor the driver involved have been released. Authorities have not yet stated whether drugs or alcohol played a role in the fatal crash.
Partial Liability in Bicycle Accidents
California Law does not consider bicyclists to have the right-of-way under all circumstances. However, motorists are never relieved of the expectation to provide bicyclists with a Duty of Care toward their safety.
It may therefore be determined that a motorist is held only partially liable in a bicycle accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
