Oildale, CA – On Tuesday, December 10, 2024, a bicyclist was struck by a vehicle and killed in Oildale, according to KGET.
The California Highway Patrol (CHP) reports that the accident occurred around 7:30 PM on Airport Drive, south of Washington Avenue, in an area reported to be poorly lit.
A witness to the accident claimed to see the bicyclist fall down in the number two lane of Airport Drive while attempting to cross the roadway. While they were getting back to their feet, they were struck by a northbound Honda Sedan traveling at approximately 40 miles per hour.
Due to the severity of their injuries, the bicyclist was pronounced dead at the scene. The driver involved remained with the bicyclist and cooperated with investigators.
The identity of the bicyclist has been confirmed by their family, but it has not yet been released to the public. Investigators have yet to determine if drugs or alcohol played a factor in this fatal accident.
Partial Liability in Bicycle Accidents
California Law does not consider bicyclists to have the right-of-way under all circumstances. However, motorists are never relieved of the expectation to provide bicyclists with a Duty of Care toward their safety.
It may therefore be determined that a motorist is held only partially liable in a bicycle accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
