Madison Ave Crash near Sunrise Blvd Kills Pedestrian in Fair Oaks

Fair Oaks, CA – A man was struck and killed Sunday night, December 1, 2024, while attempting to cross Madison Avenue near Sunrise Boulevard, close to the Citrus Heights border in Fair Oaks, according to The Sacramento Bee.

The incident occurred shortly after 7 PM, according to Sacramento Metropolitan Fire District logs. The man was crossing Madison Avenue outside of a marked crosswalk when he is believed to have stepped into the path of an eastbound Toyota, according to the California Highway Patrol’s East Sacramento office.

Emergency responders arrived, but the man succumbed to his injuries at the scene. His identity has not yet been released, pending notification of his family by the Sacramento County Coroner’s Office.

The driver of the Toyota was uninjured and remained at the scene to cooperate with authorities. The investigation into the collision is ongoing.

 

Partial Liability in Pedestrian Accidents

California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety. 

It may therefore be determined that a motorist is held only partially liable in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
