Fairfield, CA – A pedestrian was struck and killed early Thursday morning, November 14, 2024, on Interstate 80 near Air Base Parkway, according to KRON.
The California Highway Patrol (CHP) reported that the collision occurred shortly before 5 AM, leading to significant traffic disruptions in the area during the morning commute.
Emergency responders arrived at the eastbound lanes of I-80, where the pedestrian was pronounced dead at the scene. The identity of the person has not yet been released as authorities work to notify the next of kin.
CHP reported that the driver of the vehicle involved stopped immediately and is cooperating with the investigation. Preliminary findings indicate that neither alcohol nor drugs appear to have been factors in the collision.
The incident caused all eastbound lanes of I-80 to close temporarily, with traffic being diverted at Air Base Parkway. Nearby surface streets, including North Texas Street and Travis Boulevard, experienced heavy congestion as a result. The highway was fully reopened by 7 AM.
The CHP continues to investigate the circumstances of the crash and has asked anyone with additional information to come forward.
Partial Liability in Pedestrian Accidents
California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety.
It may therefore be determined that a motorist is held only partially liable in a pedestrian accident. If that is the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
