Pedestrian Fatalities and Wrongful Death Claims

Those involved in a pedestrian crash should know that motorists are required to exercise an additional “duty of care” towards pedestrians due to their heightened vulnerability in car accidents, which more often result in pedestrian fatalities.

Any statements made by a news outlet that suggest responsibility for a vehicular accident falls on one party or another are most often the reporting of an investigator’s opinion based on initial findings. Later evidence may come to light to change the outlook of how an accident occurred.

Furthermore, California law allows for partial liability to be allocated to more than one party. These allocations of fault do not depend upon criminal charges being filed.

While no amount of money can return those we lose to a vehicular accident, these fatalities often come with a heavy and unexpected financial burden in the form of medical expenses, burial costs, and the loss of income to support any dependents of the deceased.

Families who have lost a loved one in a fatal collision may be able to file a wrongful death claim with the insurance provider, with the help of a knowledgeable personal injury attorney. The compensation provided by a wrongful death claim can relieve the financial burdens created by medical expenses, burial costs, and the loss of income to support any dependents of the deceased.
