Fatal Vehicle-vs-Bicycle Crash on Hwy 46 Near Lost Hills Rd in Buttonwillow

Bakersfield, CA — According to KBAK, on April 6, 2024, a 60-year-old man lost his life in a devastating bicycle crash in Buttonwillow. The California Highway Patrol (CHP) reported that the incident occurred on Highway 46, east of Lost Hills Road, at approximately 5:40 AM.

According to CHP officers, the driver of a Chevrolet was traveling westbound on Highway 46 behind a motorcyclist, when, shockingly, the driver allegedly steered the car towards the rider and collided with the back of the bicycle using the front of the car.

The force of impact ejected the rider from the bicycle, resulting in fatal injuries. The victim’s identity has not been disclosed. Authorities are actively investigating the circumstances of the crash to bring clarity to this devastating incident.

Duty of Care Toward Cyclists and Pedestrians

Cyclists and pedestrians are owed a “duty of care” from drivers no matter where they meet. Motorists are legally obligated to monitor the roads ahead, and all mirrors and blind spots, for any rider who may be nearby. Drivers must hit the brakes to avoid any chance of a collision. This legal responsibility stems from the fact that cyclists and pedestrians travel with less protection alongside heavier and faster cars, trucks, and SUVs.

Drivers must also stop once a collision has occurred to get medical attention for a cyclist or pedestrian as fast as possible. Remaining on the scene, turning on hazard lights, and blocking off traffic also reduce the chances of the victim being struck by approaching motorists who may not be able to see an injured cyclist down in the street.

Wrongful Death Claims

Readers should be aware that statements made by journalists that may suggest fault in a case like this are often simply repeating the opinions of initial investigators, which may not be born out by later evidence.

Even in cases where criminal charges are not brought to bear, families who have lost a loved one in a fatal collision may be able to file a wrongful death claim with the insurance provider of the at-fault driver.

The compensation provided by a wrongful death claim can relieve the financial burdens created by medical expenses, burial costs, and the loss of income to support any dependents of the deceased.

Insurance companies will work to reduce any claim they cannot deny, which is where the help of a knowledgeable personal injury attorney can prove invaluable by negotiating on behalf of victims and their families to ensure they receive proper compensation.
