San Luis Obispo, CA – According to KEYT, a 43-year-old Morro Bay lost his life in a solo-vehicle rollover crash on the night of Friday, March 29, 2024.
The California Highway Patrol of San Luis Obispo (CHP SLO) responded to the fatal collision on southbound State Road 1, north of South Bay Boulevard, where they found the Morrow Bay man, who had been thrown from his 2006 Toyota.
Their investigations suggest that the driver was traveling the highway at a speed of 65 miles per hour amidst heavy rain and strong winds, factors that potentially affected his control over the vehicle.
Unfortunately, the driver lost control, and the vehicle slid off the road, colliding with a tree and flipping over. The force of the crash ejected the driver from the car, throwing him onto Quintana Road with fatal injuries.
The CHP SLO is withholding the identity of the driver pending notification of his next of kin.
Liability in Solo-Vehicle Collisions
Those who might find themselves in an accident like the one described above should be aware that some portion of liability for a solo-vehicle crash may be found to belong to circumstances outside the driver’s control such as irresponsible driving by other vehicles in the area or even unsafe roadway conditions for which local government bears responsibility. Those responsible for these outside factors may owe compensation to anyone injured in such a crash.
Wrongful Death Claims
Establishing fault in a collision can depend on multiple factors. Helping to determine legal liability is one of the ways that a personal injury attorney can help grieving families recovering from the loss of a loved one in a traffic accident.
If it is determined that another party holds even partial responsibility for their loved one’s death, the family of the deceased may be eligible to file a wrongful death claim with that party’s insurance provider. A wrongful death claim can provide compensation to help cover hospital fees, burial costs, and the loss of support for dependents of the deceased.
