Fresno, CA – On the evening of Sunday, March 10, 2024, a motorcyclist was injured when they collided with a truck back out of its driveway, according to the Fresno Bee.

Officers of the Fresno Police Department arrived at the crash side at Dakota and Fruit Avenues just after 8 PM. Investigations reveals that the drive of the truck was either pulling into or out of their driveway when they were struck by the motorcycle, which had been traveling eastbound on Dakota.

The truck driver remained at the crash site and cooperated with authorities, while the motorcyclist received transportation to a local hospital. It was reported that the motorcyclist was in critical condition.

Determining Fault in a Personal Injury or Wrongful Death Claim

Some news reports have stated that the motorcyclist was at fault for the collision. This is likely based on a police report. It is important to note that an accident report simply contains a police officer’s opinion.

However, there are a wide variety of factors courts will take into consideration when determining fault. Additionally, California is a Pure Comparative Negligence State, meaning that the injured party can still file a claim even if they did indeed contribute to the accident.
