The accident occurred just before 3 PM on northbound Highway 101 at the San Juan Road on-ramp. According to CHP investigators, Martinez was driving a GMC Sierra at an unknown speed when her vehicle veered off the roadway, flipping on the right shoulder and into the grass.
Martinez was ejected from the GMC Sierra, which landed on top of her. CAL FIRE units were dispatched to the scene to assist in moving the vehicle off of Martinez. Despite their efforts, she succumbed to her injuries at the crash site.
The investigation into the causes of the crash continues.
Wrongful Death Claims
If investigators determine that a victim like Martinez crashed as a result of another person’s reckless driving, the victim’s family may be able to file a wrongful death claim with the insurance provider of the at-fault driver. A wrongful death claim can provide compensation to help cover medical bills, burial costs, and the loss of income to support any dependents of the deceased.
However, insurance providers will dispute and attempt to minimize any claim they cannot deny. That is why grieving families can find the help of a knowledgeable personal injury attorney so crucial in securing justice for victims.
